1. Booking Confirmation
- A booking is confirmed only when Transworld Adventures issues written confirmation and the required deposit (or full payment) has been received.
- Upon receiving confirmation, it is your responsibility to review all details (itinerary, dates, inclusions, exclusions, etc.) carefully and notify us immediately of any discrepancies.
- The booking becomes binding on both parties once the deposit is paid.
- We hold an option for 7 days from the date of quotation or confirmation before standard cancellation rules apply.
- Bookings made less than 7 days prior to departure are subject to the cancellation policy immediately.
2. Deposits & Payments
- Standard deposit: A non-refundable deposit of 40% of the total invoice amount is required at the time of booking to secure your reservation (excluding flights and certain hotel reservations).
- Air travel: Requires 100% payment upfront, as tickets must be issued immediately.
- Hotel bookings: Generally require a 50% deposit.
- Special cases: Specialist products, peak-season travel, luxury camps, or group tours may require higher deposits or full prepayment.
- Balance due: The remaining balance must be paid no later than 60 days prior to the safari start date.
- Late bookings: Bookings made within 60 days of departure require full (100%) payment at the time of confirmation.
- Card/PayPal fees: Payments by credit card or PayPal may incur a handling fee (up to 4%), payable by the client.
- If payments are not received by the due dates, we reserve the right to cancel the booking and apply the applicable cancellation charges.
3. Amendments & Changes
- Any amendments to a confirmed itinerary must be requested in writing and are subject to availability, revised rates, and seasonal price differences.
- Once the safari has commenced, no changes to the itinerary can be made.
- Partial cancellations (removing individual services while retaining others) will attract cancellation fees for the cancelled portion only.
- If you request to change hotels, lodges, or room categories after check-in for personal reasons, this will be treated as a voluntary change. No refund will be given for unused nights or services, and any additional costs will be your responsibility.
4. Cancellations & Rescheduling by the Client
All cancellations must be submitted in writing to info@transworldadventures.com and take effect on the date of receipt.
Cancellation charges (as a percentage of the total safari cost):
- More than 60 days before departure: 10% forfeited.
- 60 – 30 days before departure: 20% forfeited.
- 29 – 15 days before departure: 75% forfeited.
- 14 days or less before departure, or no-show: 100% forfeited.
Rescheduling: We will gladly assist with rescheduling where possible, subject to availability, seasonal rate differences, and the terms of hotels, airlines, and other suppliers.
- Certain suppliers (hotels, camps, lodges, airlines, luxury trains, etc.) impose stricter cancellation policies. In such cases, the supplier's terms prevail.
- Airfares are completely non-refundable and non-changeable once issued.
- Confirmed hotel bookings, entry tickets, and other services are non-refundable once confirmed.
- Bank fees, credit card surcharges, and transaction fees are strictly non-refundable.
- In cases of death or serious illness, special terms may be considered upon presentation of an official certificate.
5. Cancellations by Transworld Adventures
We reserve the right to cancel or modify a tour due to circumstances beyond our control. In such cases, we will offer an alternative of equal or higher standard where possible, or provide a refund of recoverable amounts. We will endeavour to inform you as early as possible.
6. Refunds
- Refunds are governed by the cancellation policy above.
- The 40% deposit is strictly non-refundable under any circumstances.
- Where refunds are due, they will be processed within 30 working days of receiving written cancellation.
- Refunds will be issued in the original currency and payment method, net of all bank and transaction fees.
- No refunds will be given for no-shows or unutilised portions of the safari.
- We will only refund amounts recoverable from third-party suppliers when their stricter policies apply.
7. Passports, Visas & Travel Documents
- It is your sole responsibility to ensure that your passport, visas, and all travel documents are valid and correct.
- Visas for Kenya should be obtained prior to arrival (apply online at www.visa.go.ke).
- Your passport must normally be valid for at least six months after your return date.
- Transworld Adventures provides complimentary AMREF Flying Doctors evacuation cover during your safari.
- We strongly recommend comprehensive travel insurance covering cancellation, curtailment, medical emergencies, evacuation, baggage loss, and personal accident.
8. Travel Insurance
Comprehensive travel insurance is strongly recommended and, in some cases, may be a condition of travel. It is your responsibility to ensure the policy adequately covers all aspects of your trip, including adventure activities. Your policy must, at minimum, cover medical emergencies, medical evacuation/repatriation, trip cancellation, trip curtailment, and loss of personal baggage.
9. Safari & Wildlife Conduct
Wildlife viewing is conducted in wild, unmanaged environments. Guests are required to follow the instructions of guides, rangers, and camp staff at all times. Transworld Adventures and its suppliers accept no liability for injury, loss, or damage arising from a guest's failure to follow reasonable safety instructions.
10. Complaints & Service Issues
- Any issues must be reported immediately to the safari guide, lodge/camp manager, or a Transworld Adventures representative to allow prompt resolution.
- Complaints raised only after the safari ends may not be possible to resolve.
- All disputes are governed by the laws of Kenya and subject to the exclusive jurisdiction of Kenyan courts.
11. Liability
- Transworld Adventures acts only as an agent for independent suppliers and is not liable for their acts, omissions, or negligence.
- We are not responsible for events beyond our control, including weather, wildlife sightings, delays, strikes, government actions, or force majeure.
- All baggage and personal belongings are at the traveller's own risk.
- We insure clients against legal liability for injuries sustained inside our vehicles, but ultimate responsibility for safety lies with the traveller.
12. Force Majeure
Neither party is liable for failure to perform obligations (except payment obligations) due to a Force Majeure Event, including but not limited to acts of God, natural disasters, war, terrorism, pandemics, government restrictions, and similar events. In such cases, we may cancel, postpone, or modify the safari without liability. No refunds will be issued except for amounts recoverable from suppliers. We will endeavour to offer suitable alternative dates where feasible (additional costs borne by the client).
13. Credit Notes
- Credit notes are valid for one year from the date of issue.
- They are transferable only to another booking for the same client.
- Any price difference must be paid by the client.
14. Indemnity
You agree to indemnify and hold harmless Transworld Adventures, its directors, employees, agents, and suppliers from any claims, losses, damages, or expenses arising from your participation in the safari, your breach of these terms, or risks inherent to adventure travel.
15. Use of Images & Feedback
By travelling with us, you grant Transworld Adventures a non-exclusive right to use anonymous feedback and non-identifying images of your safari for marketing purposes, unless you notify us otherwise in writing before departure.
16. General Conditions
- We reserve the right to update these Terms & Conditions at any time. Updated terms take effect upon publication.
- These Terms & Conditions are governed by the laws of the Republic of Kenya.
- Any dispute shall be resolved in the first instance through good-faith discussion and, failing resolution, under the exclusive jurisdiction of the Kenyan courts.
